Pixel Polish Media LLC Terms of Service

These Terms of Service govern your access to and use of the Pixel Polish website, customer portal, ordering tools, media upload tools, video delivery services, and related services provided by Pixel Polish Media LLC, a Texas limited liability company. In these Terms, “Pixel Polish,” “we,” “us,” and “our” refer to Pixel Polish Media LLC. “Customer,” “you,” and “your” refer to the person or business using our services.
By creating an account, placing an order, uploading materials, checking out, approving a delivery, or otherwise using our services, you agree to these Terms and our Privacy Policy.

1. What Pixel Polish Does
Pixel Polish provides AI assisted real estate video production and related media services. Our services may include listing photo to video production, virtual staging or lifestyle scenes, branding, motion effects, music, voiceover, sound design, color grading, formatting for social platforms, customer portal access, review tools, and related production services.
Our services are intended for real estate marketing, listing promotion, agent branding, property media, and related commercial or professional use.
2. Eligibility and Accounts
You must be at least 18 years old to use our services.
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. You may allow members of your team to use your account when appropriate, but you remain responsible for their use. We may add formal team account features in the future.
You agree to provide accurate account, contact, order, and payment information. We may suspend, restrict, or terminate access to your account if we believe there has been fraud, abuse, nonpayment, chargebacks, prohibited content, misuse of the portal, or violation of these Terms.
3. Orders and Payment
Orders may be placed through our website or customer portal. Prices, packages, add-ons, preferred pricing, discounts, and delivery options may change at any time. However, once you complete checkout for an order, the confirmed checkout price for that order will apply unless the order scope changes.
Payments are processed through Stripe or another payment processor. We do not store your full payment card information.
We may offer standard pricing, preferred pricing, coupons, manual discounts, referral credits, or other promotions. These may be changed, paused, limited, or discontinued at our discretion.
Production and delivery may be paused or withheld if payment fails, a chargeback is opened, payment is reversed, or we believe there is fraud or abuse.
4. Refunds and Cancellations
All sales are final. Refunds may be issued at our discretion.
We may consider refunds, partial credits, or other accommodations depending on the status of production, the nature of the issue, and the amount of work already completed. We are not required to issue a refund after production has started, after files have been delivered, or where delays or issues are caused by incomplete, inaccurate, unusable, or unauthorized customer materials.
We reserve the right to reject, pause, or cancel an order for any reason, including rights concerns, prohibited content, incomplete media, payment issues, misuse of the service, or work that falls outside our production capabilities.
5. Delivery Times
Delivery estimates are estimates only and are not guaranteed.
Delivery timing is measured in business days and begins only after both of the following have occurred:
- Checkout/payment is completed.
- All required source materials, information, and instructions have been received in usable form.
Rush timing, if available, may depend on order complexity, media completeness, volume, third-party systems, AI processing, and production queue availability.
We will use reasonable communication to keep you updated if timing changes.
6. Customer Materials
You may upload or provide photos, videos, logos, branding assets, MLS information, property descriptions, floor plans, links, notes, music direction, voiceover direction, and other materials.
You represent and warrant that you have all rights, licenses, permissions, and authority needed to upload, submit, use, and authorize Pixel Polish to process those materials. This includes any rights required from photographers, videographers, brokerages, agents, homeowners, MLS providers, brands, designers, and other rights holders.
You are responsible for the accuracy, legality, and appropriateness of the materials and information you provide.
Pixel Polish is not responsible for verifying whether you have rights to the materials you submit. If a rights holder, MLS, brokerage, platform, or other party objects to use of submitted materials, you are responsible for resolving the issue and for any resulting claims, costs, or losses.
7. Ownership and License
You retain ownership of the original materials you upload or provide, subject to any rights held by photographers, videographers, homeowners, MLS providers, brokerages, brands, or other third parties.
Pixel Polish retains ownership of its pre-existing materials, templates, workflows, systems, software, editing techniques, prompts, internal processes, design elements, production methods, and other proprietary materials.
After full payment for an order, Pixel Polish grants you a commercial license to use the final delivered video and related deliverables for real estate marketing, listing promotion, social media, websites, presentations, paid ads, brokerage marketing, and related business purposes.
This license does not transfer ownership of Pixel Polish’s underlying systems, templates, tools, pre-existing assets, or production methods.
8. Portfolio and Marketing Use
Unless you opt out, you grant Pixel Polish permission to display completed work, thumbnails, video clips, property address or title, package type, property type, features, and related project information in our portfolio, website, social media, advertising, sales materials, case studies, and promotional content.
You may opt out by contacting us at info@pixelpolishmedia.com. If you are ordering on behalf of a brokerage, photographer, agency, seller, homeowner, or client, you are responsible for ensuring you have permission to allow portfolio or marketing use.
If you need private, white label, confidential, or non-public work, you must tell us before production or as early as possible.
9. AI, Virtual Staging, Lifestyle Scenes, and Accuracy
Pixel Polish uses artificial intelligence, automation, third-party tools, human review, and creative production processes to create or enhance media.
AI generated or AI assisted output may contain imperfections, inaccuracies, distortions, artifacts, hallucinated details, or elements that do not perfectly match the actual property. You are responsible for reviewing all deliverables before publishing, posting, distributing, or using them.
Virtual staging, lifestyle scenes, AI people, furnishings, décor, outdoor enhancements, twilight looks, motion effects, and similar add-ons are illustrative and may not represent the current physical condition of the property.
You are responsible for complying with all MLS, brokerage, platform, advertising, real estate, consumer protection, and disclosure rules that apply to your use of the final media. Where required, you must disclose virtual staging, AI generated elements, altered images, lifestyle scenes, or other modifications.
You may not use Pixel Polish deliverables to misrepresent property condition, included fixtures, square footage, views, location, boundaries, layout, renovations, availability, or other material facts.
10. AI People
AI people or lifestyle human figures may be available as an add-on or as part of certain creative services. You may request that AI people be excluded from your order. Some lifestyle or staging scenes may still require human review or adjustment.
You are responsible for deciding whether AI people or lifestyle scenes are appropriate for your listing, market, MLS, brokerage, and advertising rules.
11. Revisions and Change Requests
Unless a package or written agreement states otherwise, one revision or change request is included per order.
Additional revisions, scope changes, new creative direction, additional scenes, replacement media, changed property information, new music direction, new voiceover direction, reformatting, or requests made after approval may require additional fees.
We may decline revisions that are unreasonable, outside the purchased scope, based on inaccurate or unauthorized materials, or inconsistent with platform, MLS, legal, or ethical requirements.
12. Customer Review and Approval
You are responsible for reviewing deliverables carefully before approving, downloading, posting, sharing, or otherwise using them.
Approval may be submitted through the customer portal, by email, or by other written communication. Once an order is approved or used publicly, additional changes may be treated as a new revision or new order.
13. Delivery, Downloads, and File Storage
Final deliverables may be delivered through the customer portal, by email, or by hosted link.
You are responsible for downloading and archiving your completed deliverables. Pixel Polish may retain files for a reasonable period, but we do not guarantee permanent storage or availability of source files, working files, previews, or final deliverables.
We may delete or archive files, drafts, source media, deliverables, or inactive accounts in the ordinary course of business, subject to legal, accounting, security, and operational needs.
14. Prohibited Uses and Content
You may not use our services to upload, create, request, or distribute content that:
- Is illegal, fraudulent, deceptive, defamatory, harassing, hateful, discriminatory, adult, sexually explicit, exploitative, or violent.
- Violates intellectual property, privacy, publicity, contract, MLS, brokerage, platform, or other rights.
- Contains sensitive personal information that is not necessary for the order.
- Misrepresents a property, listing, seller, buyer, brokerage, service provider, or transaction.
- Attempts to impersonate another person or business.
- Interferes with our website, systems, storage, security, payment systems, or other users.
- Violates applicable real estate advertising, fair housing, MLS, or brokerage rules.
We may refuse, remove, suspend, or delete content or orders that we believe violate these Terms.
15. Preferred Pricing, Discounts, and Referral Credits
Pixel Polish may offer preferred pricing, referral credits, coupons, partner discounts, or promotional offers. These programs may be changed, limited, paused, or discontinued at any time.
Referral programs are currently soft disabled unless otherwise stated. If referral credits are active, credits are promotional only, have no cash value, may not be redeemed for cash, may expire after 90 days, and may be subject to additional rules. Self-referrals and duplicate email referrals are not allowed.
If an order is refunded, canceled, charged back, or suspected of abuse, we may void, reverse, or refuse related credits or discounts.
16. Third-Party Services
Our services may rely on third-party providers, including payment processors, hosting providers, database and storage providers, email providers, spam prevention providers, analytics providers, and AI or media processing tools.
We are not responsible for outages, delays, errors, policy changes, deliverability issues, or performance problems caused by third-party services.
17. No Guaranteed Results
Pixel Polish does not guarantee that videos, photos, virtual staging, branding, ads, or other deliverables will cause a property to sell, increase views, generate leads, satisfy a platform, comply with an MLS rule, or produce any particular business result.
You are responsible for determining whether a deliverable is appropriate for your intended use.
18. Disclaimers
Our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and error-free service.
We do not guarantee that AI output will be perfect, that third-party systems will always work, that emails will always be delivered, or that media will be accepted by any MLS, brokerage, social platform, advertising platform, or other service.
19. Limitation of Liability
To the fullest extent permitted by law, Pixel Polish Media LLC will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost profit damages.
Our total liability for any claim related to an order or service will not exceed the amount you paid Pixel Polish for the specific order giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
20. Indemnification
You agree to defend, indemnify, and hold harmless Pixel Polish Media LLC, its owners, employees, contractors, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:
- Materials or information you provide.
- Your lack of rights or permissions for uploaded materials.
- Your use of deliverables.
- Your violation of MLS, brokerage, advertising, platform, real estate, or disclosure rules.
- Your violation of these Terms.
- Your misuse of the services.
21. Account Deletion
You may request deletion of your account by contacting us at info@pixelpolishmedia.com or through available account tools.
We may retain certain information where needed for legal, accounting, payment, fraud prevention, dispute resolution, tax, security, operational, or legitimate business purposes. We may also retain order records, payment records, communications, and other information as described in our Privacy Policy.
22. Force Majeure
We will not be liable for delays or failures caused by events beyond our reasonable control, including internet outages, power failures, provider outages, payment processor issues, storage failures, AI provider downtime, weather, illness, labor issues, natural disasters, government action, platform changes, cyberattacks, or other events outside our reasonable control.
23. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules.
Unless otherwise required by law, any dispute will be brought in the state or federal courts located in Texas, and you consent to jurisdiction and venue in those courts.
24. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on our website with a new effective date. Your continued use of our services after changes are posted means you accept the updated Terms.

Payment and billing information
Payments are processed by Stripe or other payment providers. We may receive payment status, transaction identifiers, customer identifiers, order totals, refunds, chargebacks, billing status, and related payment metadata. We do not store full payment card numbers.
Contact and inquiry information
If you submit a contact form, preferred partner form, custom order request, account deletion request, or other inquiry, we may collect your name, email, phone number, company, reason for contacting us, message, account context, and related metadata.
Usage, device, and analytics information
We may collect information about your browser, device, IP address, pages visited, interactions, approximate location, session activity, referral source, performance information, and analytics data.
Cookies, local storage, and similar technologies
We may use cookies, local storage, session storage, and similar technologies for login sessions, security, referral tracking, form autosave, analytics, preferences, and site functionality.

We do not use customer data to train our own AI models. Third-party AI and media providers may process data according to their own terms, policies, and our arrangements with them. We use commercially reasonable efforts to work with providers that support appropriate safeguards.
Do not upload sensitive personal information, confidential documents, private financial information, medical information, children’s information, or other unnecessary sensitive content.
5. How We Share Information
We may share information with:
- Service providers that help us host, store, process, secure, email, analyze, and deliver our services.
- Payment processors such as Stripe to process transactions.
- Email and communication providers to send transactional or support messages.

Unless you opt out, we may display completed videos, clips, thumbnails, project titles, addresses, property types, package names, aspect ratios, feature tags, and similar project information in our public portfolio, website, advertising, social media, sales materials, and promotional content.
You may request that we not use your completed work publicly by contacting info@pixelpolishmedia.com.
7. Email Communications
We may send transactional emails related to account access, password resets, order confirmations, order updates, delivery, support, contact requests, security, and policy updates.
We may also send marketing emails, newsletters, partner pricing updates, or promotional messages. You may unsubscribe from marketing emails, but transactional emails may still be sent when necessary to provide the service or manage your account.
We do not currently send SMS/text messages for marketing. If we add SMS messaging later, we will update our practices and obtain consent where required.
8. Cookies and Tracking
We may use cookies, local storage, session storage, analytics scripts, and similar technologies to:

You are responsible for keeping your account credentials secure.

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Our services are intended for users who are at least 18 years old.

Pixel Polish is based in Texas, USA. We currently focus on customers in the United States and do not intentionally target EU or UK residents.
